Lindsay Lohan


Lindsay Lohan has filed a multi-million dollar lawsuit over an advertisement which allegedly used her name and parodied her life for profit. Lindsay is seeking $100 million in damages and compensation over the commercial from the financial firm E-Trade, which depicts a baby girl called Lindsay as a boyfriend stealer and a "milkaholic", according to the New York Post.
The commercial shows a baby boy playing the stock market and apologising to his girlfriend for not calling her the night before.The baby girl then gets suspicious about a rival female baby, referring to her as "that milkaholic Lindsay". Lohan filed the lawsuit yesterday in Nassau County Supreme Court over the advert, which debuted on television during the Super Bowl last month. Lindsay's lawyer, Stephanie Ovadia, is claiming Lohan?s first name is just as recognizable as other single-word monikers, used by stars such as Madonna and Oprah. Ovadia says, "Many celebrities are known by one name only, and E-Trade is using that knowledge to profit. They used the name Lindsay. They?re using her name as a parody of her life. Why didn?t they use the name Susan? This is a subliminal message. Everybody?s talking about it and saying it?s Lindsay Lohan." The lawyer alleges company bosses used Lohan?s "name and characterisation" without paying her or asking for her approval, thus violating her rights. Ovadia also is insisting the company has earned large profits from the promo because it would have been seen by millions of television viewers watching the Super Bowl. But chiefs at the advertising firm which created the commercial for E-Trade are dismissing the claims, insisting they chose the name Lindsay at random. Chris Brown, a spokesperson for the Grey Group, says they "just used a popular baby name that happened to be the name of someone on the account team." Lindsay is seeking $50 million in exemplary damages, as well as $50 million in compensation.

Editors Extra: This is so stupid, this case should be thrown out of court. Maybe I'll start suing everyone that uses the name James. And Lindsay is famous for drinking other things, not milk!

NIPPED AND TUCKED ? This Wednesday is the final Nip/Tuck episode after 7 years. I must admit that though I completely missed season one; I've watched it ever since season two and even when the characters up and moved (from the show's original South Beach roots) to L. A., though it did seem to get even a bit more incredulous. That said, I kept watching and this final season has evidenced not only some terrific writing, but also stellar turns from Julian McMahon and Dylan Walsh. They usually started the show by asking potential clients 'what don't you like about yourself?' One show this season started with a marriage counselor asking the two leads that question! I mean, if you buy the premise ? and, truth be told, it did get wild at times, it was captivating TV. Wednesday?s EP is entitled ?Hiro Yoshimura? and the preview did show some astounding scenes of most of the characters sitting together and actually looking like they were enjoying it. I'll miss this show just for the fact that it was out and out absurd at times. I mean, even Rosie O?Donnell was on several seasons back as a character on a reality show that fell in love with her obviously-gay producer. I know it sounds like another daily occurrence at ESPN, but it was hilarious ? trust me. Surely McMahon and Walsh will go onto greater things, but Nip/Tuck remains a formidable moment on cable TV. Don't know about you, but it remains hard for me to believe that the guy who came up with Nip Tick?s premise, Ryan Murphy, came up with ?Glee.? Amazing!

OSCARS - Here?s my yearly shot to speak on next weekend?s Oscar race. Before I state my guesses, let me just say that ?A Single Man,? starring Colin firth IS probably the best performance of the year ? from a quality standpoint I think. He'll never win the Oscar, but his performance is utterly riveting. If you haven't seen it ? you owe it to yourself too. A Tom Ford-Vogue postcard. A treat for sure. OK, here goes: BEST PICTURE: Avatar - Because it was an event and it is James Cameron after all. He has made his films events ? and, Hollywood likes that ? I think! King Of The World and all that too. BEST ACTOR: ? Jeff Bridges - What a great actor and because he deserves it; my favorite film of his, ?Fearless.?SUPPORING ACTOR: Christoph Waltz - Been around for years and Tarantino found him ? brilliant move! ACTRESS: Sandra Bullock - The performance of her career ? she was spot-on perfect! Good movie too! SUPPORTING ACTRESS: - Maggie Gyllenhaal - Riveting performance ? she?s a great actress. DIRECTOR: - James Cameron ? See above! ABBEY ROAD -- Can EMI Records really be selling the legendary Abbey Road studios in the U.K? Boy, things must be bad if the ancestral home of such legendary groups like The Beatles, Pink Floyd, Wham, U2, and Queen, is on the chopping block. Truth is, these days you can pretty much make a studio out of your apartment ? and, before you laugh, that?s more the norm these days. Still, it?s tantamount to Disney selling their copyrights! EMI is pushing the idea to pay back their investors ? as they rightly feel it?s a high priced commodity. Paul McCartney was contacted and expressed his shock and dismay. Andrew Lloyd Webber, who?s got more money than even McCartney these days, said he just might buy it. You know the famed Capitol Towers out in L. A. at Hollywood and Vine? Several years back, they closed up most of the office space and built some condos. Tragedy yes ? reality, for sure!

CARLY SIMON --- So, the U.K.-media has busted a gut proclaiming that Carly Simon has come out and said who her song ?You're So Vain? is about ... David Geffen? Coming in tandem with a new album from Carly does seem a mite too convenient ? right? Everyone from Mick Jagger to Warren Beatty have been the rumored subject of that song ? but, the media , with a nod from Simon, now claims it?s Geffen of all people. Geffen ran Asylum Records, not Elektra, where Carly was based for those hit-making years. They're saying she was jealous of the attention and affection Geffen gave to Joni. Hell, they lived together for several years ? maybe Carly should have tried that maneuver? As our savvy colleague Roger Freidman said (damn, he always gets it so right!) ?Geffen can rest easy ? he never would have been caught dead wearing an apricot scarf anyway!? My money?s on Mick ? he even sings on the song and would have had no problem singing about him. In fact, he'd probably loved it! AT&T COMMERCIAL/PERFECT DAY ---I always get a mite giddy when I hear Iggy Pop?s immortal ?Lust For Life? used as a car commercial. I mean, they edit out all the fun lines, but, it?s still Iggy! The other day I saw a commercial for AT&T and they used Lou Reed?s ?Perfect Day? as the music. Brilliantly done and realized. The visual are of a spacewalk ? just perfect, you know? Reed's an out-and-out genius.

David Patterson


PATTERSON/CUOMO/A MESS --- I never quite got David Patterson. Sure, the SNL-skit might have been a tad offensive, but I laughed right along with the rest of New York and America. Coming into office after the Elliot Spitzer debacle would have proven a raw deal for almost anyone, but he definitely flip-flopped so often it proved downright irritating. His seemingly regular attacks on the government of New York proved hurtful to hear too. Sure it isn't easy, but he took the job. Remember, he was never voted in ? nor ran. Now, he won't run ? just after saying he would a mere two weeks ago. I guess this paves the way for Andrew Cuomo to run; all these years after Papa Mario didn't because of much negative innuendo ? which was never proven. Let?s face it, it?s a cesspool there. I don't know Andrew at all ? but, maybe this is one fight not to win.

WE ARE FAMILY --- So producer Nile Rogers is writing a book. His assistant Sooze actually revealed it to me about a year ago at the China Club. According to Roger Friedman, he?s thinking of entitling it ?We Are Family,? after the successful Sister Sledge song (and, album) he produced for them. Along with paramour Nancy Hunt, Roger has cooked up many a successful idea. Be it his We Are family charity (where Micky Dolenz performed two years ? and, it was fantastic; the voice of The Monkees .. and, Chic!) or his many successful record productions with Madonna, Duran Duran, Bob Dylan, Diana Ross, the B52s, Sister Sledge, or David Bowie. First and foremost, he was the ringleader of the very influential group Chic that exploded onto the burgeoning dance music scene in the 80s. ?Good Times,? ?Dance Dance Dance,? and ?Le Freak? being three of their monster hits. For me, my favorites were always ?I Want Your Love? and ?Keep On Dancin?.? As a die-hard Hall And Oates fan, I must reference their song ?Adult Education? that Nile mixed for them ? as well as adding his dynamic guitar work. That song, to me, is one of the major pivotal rock/dance hits of the 80s. That original lineup in Chic, Rogers, with the late-Bernard Edwards, Fonzi Thornton, Tony Thompson, and vocalist Norma Jean Wright, were the forerunner of much of the dance music scene, and all these years later Chic remains the template for much of R&B music. If you've ever been to a club, you have danced to their music. It was, truly sublime. I?ll never forget one early morning in the 80s I was in a cab heading back to my Upper East Side residence, slumped way back in the cab and we stopped at the 84th and 5th Avenue exit waiting for light to change. All of a sudden I heard this tremendous music real loud, I looked up and there in a Porsche, with two extremely good looking women, was Nile. We acknowledged each other with a nod and a wink and then we both went back to business. His book, which will come via Random House, should be priceless.

Bruce Willis


COP OUT ? This Bruce Willis/Tracy Morgan epic, originally titled ?A Couple Of Dicks,? was actually rather funny. I don't know how many times Willis has played a cop ? but, rest assured he?s got it down pat. Here his cop is more of a Zen-one, as opposed to the out-ad-out commotion that some of the other roles immediately bring to mind. Kevin Smith directed, but didn't write the script (the first time that?s happened) and as a buddy-buddy flick, was not a bad one at all. I've never really come to terms with Morgan. ?30 Rock? I really don't watch and even his antics on SNL left me often nonplussed. Here?s, he seems to playing exactly the same role. After all the ?Lethal Weapon? movies, and, Murphy and Nolte in ?48 Hours? ? there really is nothing new. In fact, the one thing that certainly left me smiling was the outrageous music score done by one Harold Faltermeyer ? yes, of all the ?Beverly Hills Cop? movies of eons ago. Early on, Morgan channels dozens of lines from other such buddy/buddy movies ? including the famous ?Yippee Ki Yea? from the first ?Die Hard? movie. Willis listens and sarcastically adds, ?I never saw that one!? That was, the best moment of the film. Kevin Pollack is along here too and he?s great as always. It was the #2 movie this weekend ? so, the fan base still seems to be there for Bruce and Tracy.

Jay Leno


THE RACE IS ON ? AGAIN ? Jay Leno returns tonight as the new and former host of The Tonight Show ? with Sarah Palin as a guest on Tuesday. Nikki Finke coined the term ?Jaysurrection? and I just adore it. Suffice to say, if you're a reader of this column, you know what I'll be watching tonight, although I just might have to DVR the other guy. Kevin Eubanks announced he'd be leaving shortly, which cannot be construed as anything but another nail in the Leno Coffin. TV?s definitely strange ? all that counts is the ratings! And, if you get really bored ? you can go Jaywalkin?!

Lucy Woodward


ABRAHAM?S CUTTING NEW SPOT ? When Steve Walter?s much-loved Cutting Room shuttered last year (and, we hope to return very shortly!) his booking partner Peter Abraham told me he was going to attempt a few other shows at different spots. One year later, he?s emerged as a pivotal force in the area music scene with shows at several venues, including B.B. King?s, The Highline Ballroom, and, Le Poisson Rouge at 158 Bleecker Street in NYC. I ventured forth there Monday night and imagine my surprise when I realized that the same address also was home to The Village Gate and another much-love club called Life. Interestingly enough, before that it was the atrium and floor below of a terrifically designed apartment building ? with a dazzling inner-glass atrium. I guess the apartments are still there, but this new take on the club space was dazzling. A terrific sound system welcomes you into the main stage area, which is wide open and immediately catches just a terrific vibe. The ambiance immediately recalled all the best things from The Cutting Room. Monday?s night attraction was femme-vocalist Lucy Woodward about to release her first musical release (?Hooked?) via Verve Records. She reminded me immediately of the group Manhattan Transfer, with a bit of Kid Creole And The Coconuts thrown in for good measure. A very determined presence, she immediately won us over with her ribald sense of humor and some terrific songs, including a Peggy Lee re-do that was authentic ally superb and terrific. The album was produced for the most part by our friend Tony Visconti; a shrewd innovator in the music biz for sure; The Moody Blues; Bowie; Clapton; Santana; and, The Singhs. Abraham told is of some upcoming plans and how he'd love to have Micky Dolenz play this venue; Dolenz? PR-gadfly David Salidor was standing within earshot, no doubt trying to figure out such a scenario. A Dolenz-show at The Cutting Room was in the works ? but, never happened. He'd sound terrific here. Abraham?s a savvy raconteur of the music scene in New York and a delight to work with. His next show here is March 19 with the Stay-At-Homes ? the Runaways tribute band. Go ? you won't be disappointed. We're hoping to get a copy of her new CD and will give it a full on review. She's saucy ... we love her!

Matt Damon


DAMON DAMMIT --- Matt Damon, whose performance is always terrific and he seems to have just a terrific sense of humor about himself (who can forget his show-arc on HBO?s Entourage where he tried to get Vince to do a PSA ? even after he had gotten Bono!) will be headlining a movie about Robert F. Kennedy. Deadline Hollywood?s Nikki Finke said it best, calling Damon an actor with ?chops and bankability.? The film will be based on the Evan Thomas biography entitled His Life and will be the actor?s first portrayal of a real figure like Kennedy. True, he just played South African rugby star Francois Pienaar in "Invcitus", and was superlative. The film will cover RFK?s evolution from the younger brother in the shadow of JFK to him becoming a prominent, and polarizing national political figure before he was gunned down in 1968. Watching TV tapes of him from all those years ago, I?m constantly struck by how moving and charismatic a character he was. I'm thinking of the wonderful JFK epic by Oliver Stone, which I truly loved. Hope this one will be as good.

Regis Philbin


SHEEN IT --- My favorite Charlie Sheen story was several years back, when Regis? ?Who Wants To Be A Millionaire? was on every night, and Sheen?s then-publicist Jeff Ballard was one of the contestants. Philbin asked him what he did, and when he said he was Master Charlie?s PR man ? Regis without skipping a beat said, ?That must be some job ? right?? Regis, that?s why we love you! I must admit over the years, I've enjoyed 90% of what Sheen has done on the screen and even when I watch his current TV show, I can?t help but laugh. He seems to have a sense of humor about himself, which I can't find, fault with. I wish him all the best. Don't you?

Bruce Willis


BRUCE JUICE ? Many years ago, I helped put together a magazine called Flash ... yes, I know, no laughter please. We decided to launch the magazine at a hot, NY club at the time called Kamikaze. Imagine my surprise, when during a lull in the evening I decided to chat up one of the bartenders ? as he filled my glass every time I took a drink (now wonder I chatted him up!) ? the bartender turned out to be a very young Bruce Willis. I found him totally delightful as he told me he was looking for his big break, I really hoped then he'd get it. Guess he did. Willis new movie (?Cop Out?) opens Friday, I'm seeing it tonight and he?s mentioned in several interviews that another Die Hard is in the works ? as well as a follow up to Unbreakable ? which I really loved. Go get ?em Bruce!

CURATOLA SPEAKS ? Vince Curatola, who so strongly essayed Johnny Sack in David Chase?s ground-breaking show The Sopranos, said of that classic finale, ?I would have loved to have seen a long shot of the exterior of the Sopranos house ? windows open, drapes blowing ? abandoned! The family having disappeared.? Curatola is slated to be at tomorrow's premiere via The Cinema Society) of the new Matt Damon movie The Green Zone ... details to follow!

ROSENBERG & ROSENBERG ? We first met Warner Brothers Records? PR-gal Liz Rosenberg 25 years ago. She?s been the mouthpiece for the label ever since (staring there in 1971), handling everyone from Stevie Nicks to Fleetwood Mac to Rod Stewart, Cher and Prince, but the one artist that she really made her mark with was Madonna. As our colleague Roger Friedman said, ?She?s had to turn lemons into lemonade? many times over. From Madonna?s various scandals, to her marriages and divorces. Truth be told, when Madonna?s sex-book came out in 1982, I really thought it might be over for the singer, but La Liz turned it around. The music business has changed so much of late, that there really isn?t even a WB-label anymore. She?ll segue into her own shop and am quite sure she land on her feet. She?s as great gal, certainly hardened by her travails, but a true delight. All the best Liz!

SHORT HITS --- I know the music business isn't in great shape these days, but you'd still think the labels, and especially the people funding these labels, would want to generate any visibility as possible. In the last two weeks, we've attempted to get review copies of the new CD from the terrific group, The Blind Boys of Alabama and a copy of the new Regis & Joy Philbin album; which we raved on about an appearance by the two on a recent David Letterman. The former is on an indie label named Saguaro Road Records, while the Philbin?s opus is on Big Dot Records, actually started by musicians ? so you'd think they know. I always wondered if the artists themselves know about practices things like this. Most artists I know would give their right arm for a review ? even a decent one. Now, Lisa DiAngelo over at Interscope actually messengered the Lady Gaga and One Republic CDs over to us. Now, that?s classy ? and, that?s why Interscope is such a success. I fondly recall an ad in the industry sheet Advertising Age, wherein there was a completely black page ? with the words written in white on the bottom, saying simply, this is what happens when you don't advertise ? nothing! I also want to give a shout out to one Jim Senetto aka Blackpool Jimmy, one of the best graphic artists we have right now. Some of his work has been shown at The Cutting Room and he?s pone portraits of Chris Noth, Steve Walter, Mark Bego, and, David Salidor, and, countless others. He just did the logo for the group Modern Clockwork we've been telling you about. Outstanding work ? I sure hope you fondly recall the name Robbie Robertson ? of The Band. Since the members went their separate ways, he?s been involved in a myriad number of projects, working at the original DreamWorks Records; working with Eric Clapton; being the music supervisor on a number of films, most recently ?Shutter Island? from Marty Scorsese. We bumped into him on 55th street the other day, fresh from Shutter?s premier Monday night at The Ziegfeld and he couldn't have been nicer. Robbie, a true gem!

Pop legend Madonna wants to cash in on her celebrity status as a fashion icon. The Material Girl is in talks to design her own clothing line with the department store Macy?s. Now Madonna is negotiating a high end deal with Macy?s bosses to bring her fashion style to life in a collection of clothes, accessories, underwear and footwear, reports Women?s Wear Daily. Executives at the clothing company Iconix Brand Group Inc. which also bought Jay-Z?s Rocawear line for $204 million, is also believed to be involved in the venture.

The uneasy crossover between art and celebrity has been much discussed in recent years. Artists as celebrities is hardly a new phenomenon, but the growing cult of celebrity in contemporary culture is throwing up paradoxical ideas about the contradictions between "high" art and mass appeal and blurring the already unstable boundaries between art, commodity and popular culture.

This is a lively and accessible study of the phenomenon -- the glitzy world where art and celebrity meet -- informed by a fundamentally serious look at what happens when the "serious" world of art collides with celebrity.

Global culture is now dominated by celebrities, some of whom -- like Madonna and Stallone -- are art collectors and some -- like Dennis Hopper and David Bowie -- are spare-time artists. Following the cancellation of four previous shows due to exhaustion, the pop sensation unleashed a high-energy performance in New York Wednesday night as part of her Monster Ball Tour, and delivered the first of her four sold-out performances at Radio City Music Hall.

The singer, 23, put on quite the show for her hometown crowd, which included Sting, wife Trudie Styler, Donald Trump and, according to a source, Madonna and daughter Lourdes. She opened with "Dance in the Dark," wearing a costume featuring lightbulb-like adornments, followed by "Just Dance," with her playing a keytar and strutting onstage like a human disco ball.

"American Idol" star Adam Lambert has a mentor in Madonna, after she gave him career advice during a guitar lesson at her New York City home. Adam was stunned when he discovered his guitarist was Madonna's guitar teacher, and thrilled when he was invited to her house for a music lesson. Lambert told Oprah, "That was actually the first time I can remember getting super star struck ... I had a great conversation with her. My guitar player is her guitar teacher and, we were both in New York, and he said, 'You know, I'm giving her a guitar lesson. Would you like to come over?' "I went to her house ... and she came in in, like, no make-up, yoga wear, just totally Zen. ... She walked into the room and her presence is very powerful ... and, at first, I could tell she was kinda checking me out ... and the first thing I said to her was, 'Oh my God.' "I talked to her about celebrity and how to deal with it all and she gave me a couple of words of wisdom -- she said, 'Just keep your eye on the prize and put your blinders up and don't get sidetracked with all the extra fuss.'"

Madonna Public Relations spokeswoman Liz Rosenberg is denying gossip reports that the singer is rekindling her romance with loser Sean Penn, after the former couple were spotted together in New York City. Madonna was rumored to have revived her relationship with Penn, who she married in 1985, after they were seen chatting over a meal at Adour restaurant in the city on Thursday. But the Material Girls publicist is insisting it was a chance meeting between former lovers - and not a date at all. Rosenberg says, "Madonna was at the St. Regis having dinner with friends. Sean stopped by the table to say hello. He sat for ten minutes and then left. Madonna continued with her dinner. That's all it was."
